Terms of Service for Construction and Home Improvement Services by 3 Guys Enterprises

These Terms of Service govern the provision of construction and home improvement services by 3 Guys Enterprises ("we," "us," or "our") to you ("you" or "Client"). By engaging our services, you agree to be bound by these terms.

1. Agreement for Services

The specific details of the services to be provided, the project scope, timeline, and payment terms will be outlined in a separate written agreement or proposal (the "Service Agreement") between 3 Guys Enterprises and the Client. In the event of any conflict between these Terms of Service and the Service Agreement, the terms of the Service Agreement shall prevail.

2. Project Scope and Changes

The scope of work will be as defined in the Service Agreement. Any changes or additions to the agreed-upon scope of work must be documented in a written "Change Order" signed by both 3 Guys Enterprises and the Client. Additional charges and adjustments to the timeline may apply to Change Orders.

3. Payment Terms

Payment terms, including the project cost, payment schedule, and accepted methods of payment, will be specified in the Service Agreement. Unless otherwise stated, payments are due in accordance with the schedule outlined. Late payments may be subject to interest charges as permitted by law.

4. Client Responsibilities

The Client agrees to provide reasonable access to the project site, ensure the site is safe and free from hazards (unless the hazard is part of the service to be performed), and provide any necessary utilities as agreed upon in the Service Agreement. The Client is responsible for obtaining any necessary permits unless otherwise specified in the Service Agreement.

5. Warranty

We stand behind the quality of our workmanship. Any warranties applicable to the services provided will be detailed in the Service Agreement or a separate warranty document. These warranties are typically limited to defects in workmanship for a specified period. Manufacturer warranties may apply to materials used in the project and are subject to the manufacturer's terms.

6. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to our services shall be limited to the total amount paid by you under the Service Agreement. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

7. Termination

Either party may terminate the Service Agreement under the conditions specified therein. Typically, this includes material breach of the agreement. Upon termination, the Client shall pay 3 Guys Enterprises for all services performed and materials provided up to the date of termination, as outlined in the Service Agreement.

8. Governing Law

These Terms of Service and any related Service Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

9. Entire Agreement

These Terms of Service, together with the applicable Service Agreement and any written Change Orders, constitute the entire agreement between the parties with respect to the services provided and supersede all prior or contemporaneous communications and proposals, whether oral or written.
